Draft 2027 Programmatic Agreement seeking public comment

SANTA FE – The New Mexico Department of Transportation (NMDOT), in cooperation with the Federal Highway Administration (FHWA), is requesting public comment on the draft 2027 Programmatic Agreement among FHWA, NMDOT, the New Mexico State Historic Preservation Officer (SHPO), and the Advisory Council on Historic Preservation (ACHP). Public input on the draft 2027 agreement will help inform the final agreement and ensure the process continues to effectively balance New Mexico’s transportation needs with the stewardship of the state’s cultural resources. 

The Programmatic Agreement establishes a framework for how the Federal-Aid Highway Program in New Mexico complies with Section 106 of the National Historic Preservation Act, helping NMDOT and FHWA identify, evaluate, and consider historic properties and cultural resources as part of transportation project planning and development.

The updated draft agreement is intended to refine, streamline, and standardize the processes used to meet Section 106 requirements, while continuing to support the protection and preservation of New Mexico’s rich cultural heritage. NMDOT welcomes comments, questions, and suggestions from interested members of the public, agencies, Tribal Nations, local governments, preservation organizations, and other stakeholders.

The current Programmatic Agreement expires on December 28, 2026.
